Over 75% of Employees Lose Before Ever Getting to Trial

While employees are at a disadvantage in the workplace, they face even bigger hurdles during litigation. A Federal Judicial study showed 75% of employees lose their case at the summary judgment stage (ie. before trial.) When a company is sued for discrimination, it often will have its attorneys file a motion to dismiss the case after discovery. This motion is referred to as a “summary judgment” motion. If the employer is successful, the case is over, the employee loses the case, and the case never even gets to a jury.
