Employment Discrimination

Employment discrimination occurs when a worker faces an adverse employment decision that is based on a protected characteristic. Adverse employment decisions may involve failure to hire, termination, failure to promote, demotion, and disparate pay. Employment discrimination is prohibited under the New York City Human Rights Law and the New York State Human Rights Law, each of which protect a range of characteristics.

Several federal laws prohibit employment discrimination and protect different characteristics. In general, federal laws only cover midsize to large employers. For instance, Title VII of the Civil Rights Act of 1964 prohibits discrimination against employees of companies that have at least 15 employees; characteristics it protects are race, color, national origin, religion, and sex.

When Ms. Mazur gathers information about what happened to you, she will try to obtain the full facts to make sure that our attorneys can seek all available relief. Sometimes more than one protected characteristic is implicated and it is difficult to figure out which one is the reasonable for discriminatory decisions such as termination. Suppose, for instance, you are a dark-skinned, Black trans woman who suffers from fibromyalgia. If you were terminated a few months after asking for accommodation, and a former coworker told you that your supervisor used a racial slur against you out of earshot, you may not be sure which of your traits was the basis for the termination. You may seek relief based on your race, color, gender identity, and disability. Ms. Mazur will ask you about details of your situation that would shed light on the nature of the claims we should pursue on your behalf.

Sexual Harassment

Federal, state, and local define sexual harassment differently. However, generally, it occurs whenever unwelcome conduct is inflicted on an employee due to his or her sex. Sexual harassment can include unwelcome remarks, derogatory comments, touching, groping, untoward or lewd jokes, assault and even rape. Under Title VII, sexual harassment creates a hostile work environment if it is either severe or pervasive. However, the state and local standards are more inclusive of the potential harm inflicted by harassing conduct. Under the New York State Human Rights Law, our lawyers can hold your employer accountable when harassing conduct subjects you to inferior terms, conditions or privileges of employment due to your membership in a protected class.
