Same-Sex Sexual Harassment in the Workplace

Sexual harassment is defined by unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature that is made a condition of employment, the basis of an employment decision, or that contributes to a hostile working environment. While most forms of sexual discrimination are associated with heterosexual relationships, a sharp increase in the number of same-sex harassment complaints is beginning to raise public consciousness of this issue. The problem, however, has been present for a while. EEOC statistics reveal that the number of same-sex harassment charges has doubled in the last 5 years. Our sexual harassment attorneys in New York fight for your rights.

Examples of same gender sexual harassment include:

  • Taunts about genitalia
  • Lewd comments or jokes
  • Verbal or sexual assaults
  • Intimidating same-sex victims
  • Sexually suggestive simulations
  • Derisive “flirting” or feigned attraction

Don’t Be a Victim of Sexual Harassment in New York

Our sexual harassment attorneys offer free consultations in New York City. Like other forms of harassment, the victim is often embarrassed to speak up about unwelcome conduct. The humiliation is compounded by the fact that the sexual advances are perpetrated by members of the same sex. Men are especially reluctant to “snitch” on superiors or co-workers who take advantage of the victim’s vulnerability. Further, both genders tend to downplay the harassment as a form of “joking” and blame themselves for taking the joke personally. But tolerating such “horseplay” almost never benefits the victim; the harassment often escalates into humiliating and often sadistic behavior that can have serious legal consequences for employers..

Our New York gender discrimination lawyers handle sexual harassment cases in the New York area. Our consultation is free and there is no fee unless we recover. Call us at (866) 229-9441.

Laws Prohibit Same Gender Sexual Harassment in the Workplace

Same-sex harassment violates New York state and federal laws. In Oncale v. Sundower, the Supreme Court held that Title VII of the Civil Rights Act prohibits same sex harassment. An individual therefore has the right to bring a claim for workplace harassment when the perpetrator and victim are of the same sex. In this case, the victim was subjected to humiliating sex-related actions and even threatened with rape. Supervisors took no remedial action. In fact, one superior exposed his penis and placed it on the victim’s body. Co-workers also attacked the victim in the shower and sodomized him with a bar of soap. The Supreme Court found that the Title VII prohibition against sexual harassment includes same-sex claims as well as those that condition liability on the same-sex harasser being gay or lesbian.

Same-Sex Harassment in New York is Illegal

New York State law also protects victims of same-sex harassment by covering smaller employers and perpetrators not subject to Title VII. Even in small companies employing fewer than 15 workers, victims of same-sex harassment can file a sexual harassment claim against their employer and any other party responsible for creating a hostile work environment. Unlike “quid pro quo” harassment, in which employers expect a “favor for a favor,” claimants can show that supervisors created a hostile workplace by either participating in the harassment or failing to take remedial action once they were placed on notice of the conduct. An experienced New York sexual harassment attorney can explain how these federal and state laws apply to your case and help present your claim in the most favorable light.
