Employee-Only Representation for Miami Sexual Orientation Discrimination Claims
At Phillips & Associates, PLLC, we represent Miami employees who believe they were treated unfairly because of their sexual orientation. Discrimination can affect hiring, compensation, promotions, discipline, assignments, schedules, training, or termination. Federal law and the Miami-Dade County Human Rights Ordinance may provide separate, sometimes overlapping paths for pursuing a claim.
Our Miami sexual orientation discrimination attorneys evaluate the statements of decision-makers, the treatment of comparable employees, the timing of adverse actions, and available workplace records. Our broader employment law practice serves workers in Florida, New York, New Jersey, and Pennsylvania.
To discuss possible sexual orientation discrimination at work in Miami, FL, call our attorneys at (866) 229-9441. We can review what happened and explain the legal options that may apply.
Sexual Orientation Discrimination in the Workplace
Sexual orientation discrimination occurs when an employer treats a worker unfavorably because they are lesbian, gay, bisexual, heterosexual, perceived to have a particular sexual orientation, or associated with someone of a particular sexual orientation. The conduct may involve a single employment decision or a pattern of unequal workplace treatment.
Examples of conduct that may support a claim include:
- Refusing to hire or promote a qualified employee because of sexual orientation
- Paying an employee less than comparable coworkers performing similar work
- Assigning less desirable shifts, duties, territories, or work locations
- Applying performance or disciplinary standards inconsistently
- Terminating an employee after learning about the employee’s sexual orientation
- Using slurs, threats, ridicule, or intrusive comments about relationships
Workplace harassment may be legally actionable when it is severe or pervasive enough to alter working conditions or when it is connected to a tangible employment action, such as demotion or termination. A hostile work environment can involve repeated insults, offensive messages, degrading images, threats, or other conduct tied to sexual orientation.
Retaliation can become a separate legal issue when an employer takes adverse action after a worker reports discrimination, opposes unlawful conduct, or participates in an investigation. Our team can assist you with further issues such as employment discrimination, sexual harassment, and retaliation matters.
Federal & Florida Protections Against LGBT Discrimination
The Equal Employment Opportunity Commission (EEOC) enforces Title VII of the Civil Rights Act of 1964. This law prohibits sex discrimination in the workplace. The EEOC has interpreted that to mean that sexual orientation discrimination (along with gender identity discrimination) is also prohibited as a subset of sex discrimination. Furthermore, Title VII case law prohibits discrimination based on sex/gender stereotyping, which sometimes applies to sexual orientation discrimination cases.
The Florida Civil Rights Act also prohibits sex discrimination. The availability and scope of state-law claims should be assessed separately from Title VII because the governing language, employer coverage, filing requirements, and available remedies may differ. Our LGBT discrimination attorney in Miami evaluates claims under the federal, state, and local laws supported by the worker’s circumstances.
Title VII claims commonly begin with an EEOC charge, which is a formal administrative complaint filed before a federal lawsuit. Filing deadlines can depend on the employer, the location, the legal theory, and whether another agency has authority over the matter. Employees shouldn’t assume that an internal human resources complaint pauses an outside filing deadline.
Miami-Dade County Human Rights Ordinance
It is illegal under the Miami-Dade County Human Rights Ordinance, which is found in Chapter 11A, for employers to discriminate in employment based on employee sexual orientation. Under this ordinance, an employee can file a discrimination complaint with the assistance of a Miami sexual orientation discrimination attorney.
The Commission on Human Rights Board is the quasi-judicial and advisory board that enforces this law. The Board’s staff conducts intake, mediation, investigation, conciliation, administrative hearings, technical assistance, and outreach.
If you are aggrieved by the Board’s Director’s recommended final order related to a sexual orientation discrimination claim, you can ask for a hearing before a panel of the Commission within 15 days of the Director’s findings. Within 180 days of your filing a complaint with the Director, if the Director was not able to get voluntary compliance, you can ask for a notice of right-to-sue. If it is issued, the jurisdiction of the Director and Board is terminated. Within 90 days of receiving that notice, you can sue for sexual orientation discrimination. If the court determines that sexual orientation discrimination has occurred it can order the practice prohibited and award, not only injunctive relief, but also actual and punitive damages, reasonable attorneys’ fees and costs, and other proper relief.
Evidence in an LGBT Discrimination Claim
Employment evidence can help show why an employer made a decision and whether its stated explanation is consistent with the workplace record.
Before contacting our attorneys, consider preserving:
- Messages or documents containing discriminatory comments
- Disciplinary notices, performance reviews, and schedules
- Records showing changes in pay, duties, hours, or evaluations
- Names of witnesses who observed relevant statements or decisions
- Copies of complaints and the employer’s responses
- A dated timeline of discrimination and retaliatory conduct
Don’t alter, delete, or annotate original communications. Keep lawful copies of records already available to you, but don’t access restricted systems or remove confidential materials without legal guidance. The timing between a complaint and later discipline, demotion, schedule change, or termination may also be relevant to the analysis.
