Race Discrimination

Philadelphia Race Discrimination Lawyers

Employee-Side Racial Discrimination Representation in Philadelphia

Employers are prohibited from discriminating against you based on race, but racial discrimination still occurs on the job. If you believe that you have been subjected to racial discrimination, it is important to consult an experienced Philadelphia racial discrimination lawyer.

At Phillips & Associates, PLLC, our Philadelphia racial discrimination attorneys represent employees exclusively and evaluate claims for available damages. We serve workers throughout Pennsylvania and maintain a Philadelphia-area presence for employment discrimination and retaliation matters.

Racial discrimination can affect every stage of employment, such as hiring, onboarding, pay, assignments, promotions, discipline, training, and termination. A worker evaluating a potential claim may need to consider federal, Pennsylvania, and Philadelphia protections together because the applicable law can depend on employer size, the conduct at issue, and which agency or court the claim is filed with.

Call us today at (866) 229-9441 or contact us online to schedule a consultation with our racial discrimination lawyer in Philadelphia.

Common Forms of Race Discrimination

Section 1981, Title VII of the Civil Rights Act of 1964, the Pennsylvania Human Relations Act, and the Philadelphia Fair Practices Ordinance prohibit workplace race discrimination in Pennsylvania. Employers can’t treat employees differently based on actual or perceived race, color, or ethnicity.

Racial discrimination can appear in both obvious and subtle forms. Examples may include:

  • Being denied a job
  • Being passed over for a promotion
  • Being paid less than similarly situated coworkers of a different race
  • Being assigned less desirable work or shifts
  • Being disciplined more harshly for the same conduct
  • Being excluded from training or meetings
  • Being evaluated under different standards
  • Being terminated because of race, color, ethnicity, ancestry, or a perceived racial characteristic

Title VII prohibits employers from making employment decisions based on race, including hiring, firing, promotions, pay, raises, training, and other employment opportunities. For example, discrimination may occur when a less qualified employee of another race receives a raise or training opportunity, or when an employer takes action because of customer preferences regarding an employee's race. Title VII generally applies to employers with 15 or more employees. A racial discrimination lawyer in Philadelphia can help determine which federal or state protections may apply.

Racial Harassment

Racial harassment is also a form of racial discrimination under Title VII. Racial harassment can include offensive jokes, slurs, racist comments, and racist images, and it is actionable if it creates a hostile work environment. A hostile work environment is one in which the terms and conditions have been altered by harassment, such that a reasonable person would find the work environment abusive or hostile, and the claimant also subjectively finds the work environment to be abusive or hostile.

Employees should document instances of harassment as thoroughly as possible, recording:

  • Dates
  • The names of everyone involved
  • Exact words or conduct
  • Any witnesses present
  • Reports made to management or human resources
  • Any changes in working conditions that followed
